According to documents lodged with the Federal Court, Mr V'landys claims he was "greatly injured" by his portrayal in the program, and his -reputation was brought into "public disrepute, ridicule and -contempt". The 7.30 story The Final Race, reported by Caro Meldrum-Hanna and aired in Oct-ober, alleged hundreds of former racehorses were sent to abattoirs. It showed disturbing undercover video footage of animal cruelty. Mr V'Landys agreed to appear in the program to respond to claims on behalf of Racing NSW, saying no horses in the state were being sent to abattoirs. His legal team, headed by barrister Bruce McClintock SC, will seek aggravated damages, claiming the ABC acted "dishonestly" by failing to disclose to him undercover video footage obtained in NSW and Queensland that was shown in the program. The V'landys legal team will also argue he was not given an opportunity to explain that Racing NSW had no jurisdiction in Queensland, where most of the racehorses sent to slaughter came from. A month after The Last Race went to air, Racing NSW chairman Russell Balding, a former managing director of the ABC, filed an official complaint with the national broadcaster, alleging "serious and numerous breaches of the ABC's statutory duties, editorial policies and code of practice". Mr Balding's complaint covered 15 issues and alleged errors in the 7.30 program, including the circumstances of the interview with Mr V'landys. The complaint was also highly critical of the program's timing, arguing it was scheduled to have maximum impact before The Everest race at Randwick and the Melbourne Cup. The ABC's audience and consumer affairs unit cleared 7.30 and Meldrum-Hanna, finding no breach of editorial standards. An ABC spokesman said in January there was "no substance to the . complaint and it also contained inaccurate statements and erroneous claims". Immediately after the program aired, Mr V'Landys unequivocally condemned the "alleged abhorrent actions of the Meramist Queensland abattoir" where acts of animal cruelty were shown. He said the vision was "sickening and horrendous" and called on the Queensland government to take the strongest possible action. He also said Racing NSW was the only state with a "Rule of Racing" that prohibited horses being sent to a knackery or abattoir if they had been predominantly domiciled in the NSW industry. Documents from his legal team say it will be argued the 7.30 investigation implied Mr V'Landys "callously permitted the wholesale slaughter of thoroughbred horses". On one side are eight of the owners of champion sprinter Redzel, which took home the trophy plus $5.8 million in prizemoney after winning Australia's richest race The Everest in 2017. They have launched legal action against Triple Crown Bloodstock, which sold shares in Redzel and manages the syndicate of owners, claiming it sold the trophy without their permission to an unknown third party for an undisclosed amount. In the other corner is Triple Crown, which yesterday said the company "will be vigorously defending the claim". A dispute over Redzel's The Everest 2017 winning trophy will be played out in court. "We are surprised and disappointed that this action has been taken," the company said in an email. "The proceedings are completely without merit. The allegations were investigated by Racing NSW last year and Triple Crown was cleared of wrongdoing." The company did not respond to questions about whether the action could be ended by simply producing the trophy. The statement of claim was filed by the owners' lawyer Mark Carmody in the Sydney District Court on February 20. According to the document, the owners are seeking "restitution", "damages", "interest" and "costs" over the trophy. The matter has been listed for a pre-trial conference on April 8. "The owners simply want the trophy they own," Mr Carmody said. "It's early days as we've only just filed the statement. Check in when we're on the home straight and the whips are cracking." The centrepiece of the trophy is a horse encrusted with about 8000 black and white diamonds topped off with seven kilograms of silver and two rubies. Timothy Cheng, a 5 per cent owner of Redzel, is listed as the first plaintiff and is joined by eight other shareholders in the horse who own a combined 50 per cent of the seven-year-old. "The owners just want to be told if the trophy has been sold," Mr Cheng said. "If it hasn't, we just want to see it." Nine other owners hold the other 50 per cent and have not joined the legal action. According to the documents, Triple Crown "assumed possession" of the trophy "on or about" October 14, 2017, the same day Redzel won the 1200m race at Royal Randwick Racecourse. The owners claim in the documents that Triple Crown was only to hold the trophy and had no rights to sell or transfer it. Trainer Jason Servis, whose stable includes Maximum Security, winner of the $20 million Saudi Cup, has been charged with administering performance-enhancing drugs to that horse and others. Maximum Security crossed the line first in the 2019 Kentucky Derby but was disqualified for interference and has since won four of his five high-profile races. The charges against trainers, veterinarians and others are detailed in four indictments unveiled in Manhattan federal court. Charges brought against the 27 people include drug adulteration and mis-branding conspiracy. Performance-enhancing drugs "were given to racehorses in an effort to increase their performance beyond their natural abilities," William F Sweeney Jr, assistant director in charge of the FBI New York Office, said at a news conference. "What actually happened to the horses amounted to nothing less than abuse. "They experienced cardiac issues, overexertion leading to leg fractures, increased risk of injury, and, in some cases, death. "Conversely, the human being involved in the scheme continued to line their purses as they manipulated this multibillion-dollar horse racing industry across the globe." Authorities say the drugs can cause horses to over-exert themselves, leading to heart issues or death. According to the indictments, other drugs used to deaden a horse's sensitivity to pain to improve the horse's performance could also lead to leg fractures. Authorities said participants in the fraud - affecting races in New York, New Jersey, Florida, Ohio, Kentucky and the United Arab Emirates - misled federal and state regulators, US Customs and Border Protection agents, various state horse racing regulators and the betting public. National Thoroughbred Racing Association president and chief executive Alex Waldrop called the charges "abhorrent". Trainer Jason Servis is among more than two dozen officials charged by authorities Picture: AP "There is no place in our sport for individuals who treat horses with disregard for their wellbeing or who undermine the integrity of our competition for personal gain," Waldrop said. Federal authorities searched barns in Florida and a manufacturing facility in Kentucky. In the indictment, Servis is charged with giving Maximum Security a performance- enhancing drug called SGF-1000, recommending it to another trainer, and conspiring with a veterinarian to make it look like a false positive for another substance. The other trainer, Jorge Navarro, is among those charged. Servis is alleged to have given performance-enhancing drugs to "virtually all the racehorses under his control". "The charges in this indictment result from a widespread, corrupt scheme by racehorse trainers, veterinarians, PED (performance-enhancing drug) distributors and others to manufacture, distribute and receive adulterated and mis-branded PEDs and to secretly administer those PEDs to racehorses under scheme participants' control," an indictment reads. "A sad day for racing but a long time coming," trainer Graham Motion tweeted. "A good day for those who try to play by the rules, we will all be better for it." Justice Robert Bromwich said The Age article dealt with allegations of match-fixing in certain games in the National Rugby League competition, Mr Hayson being banned from betting at the TAB and associated allegations. Hayson took legal action in the Federal Court regarding the June 2016 article in The Age, which followed a similar article in The Sydney Morning Herald. "I readily infer that no real attempt was made by Ms McClymont to check or verify the story that was published, or to give Mr Hayson any real opportunity to comment, when it relied upon (Con Ange) a person with a known personal animus towards him," Justice Bromwich said in his judgement published Thursday. During the legal proceedings, The Age conceded claims involving match-fixing and placing a bet on the game were defamatory. However the newspaper sought to mitigate damages on grounds of Mr Hayson's "bad reputation" in sporting and gaming communities, including by way of conventional insider trading in sports-related gambling. Justice Bromwich said Mr Hayson admitted in court to having knowingly entered Star Casino gaming areas in breach of exclusion areas, falsely stating the order had been overturned. "The better explanation is that Mr Hayson did not think that this mattered very much, which is not to his credit either," Justice Bromwich said. "This is evidence of Mr Hayson's willingness to lie when it is to his advantage . It indicates a determination to do as he pleases, and to lie about it if that is necessary to get what he wants." Justice Bromwich said there was a great difference between lying to a duty manager at a casino and lying on oath in court. "Nonetheless, Mr Hayson's attitude towards legal obligations and to telling the truth when that was an impediment to getting what he wanted caused me to scrutinise his evidence more closely, and to be less willing to take what he said at face value," he said. He said the admission that Mr Hayson placed a substantial bet on Auckland to beat Newcastle in an NRL game, knowing key Newcastle player Andrew Johns would withdraw from the match due to a neck injury was not "perfectly honest", as characterised by Mr Hayson. "Insider trading in sports-related gambling is inherently dishonest," Justice Bromwich said. The court also heard Mr Hayson manipulated odds by placing bets on greyhounds that were not the favourite, in order to better the odds on the favourite over which he had already placed a substantial bet, in the moments prior to a race. "I agree that, while this may not have been illegal, it was at least of questionable morality and was not honest behaviour, which goes to Mr Hayson's credibility," Justice Bromwich said. Mr Hayson gave evidence that people who fix matches are "the lowest form of life to ever exist". Justice Bromwich said insider trading and match-fixing were both forms of cheating and should go together. "The reputation for insider trading serves to diminish his reputation in the sector, and thereby reduce, the damaging effect of The Age article because of his already tarnished reputation," he said.
